Insurance Carrier: Possibly Blue Cross Blue Shield

Consumer Complaint:

My employer does not carry workmans comp. I was not aware of this until after I was injured on the job. I cut my thumb on a meat slicer. I went to the hospital nearby and got services. At the hospital they called my employer who said he did not carry workmans' comp. but for them to send the bill to my employer. It has been 8 months and my bills, over $2000, are still not paid. My employer said that he carries Blue Cross/ Blue Shield insurance but they are trying not to pay it, saying that since the hospital did not give me a drug test that they did not want to pay it. I am also paid cash. so I need to a w-9 from them still for last year to file. Is there a penalty to them for not getting me the w-9 by January? I dont know what my rights are.

If you were an "employee" it is about 99 out of 100 the employee was required to carry workers' comp. Failure to carry it is a serious offense. Here's what we suggest. Go to www.attorneypages.com and look up a personal injury lawyer in Texas and call the lawyer. If the boss failed to have the required insurance the damages is will be required to pay should dwarf what you'd get from workers, comp.
