Complaint 1 of 6 in "Pre-existing Conditions"

Insurance Carrier: United Health Care
State: New Jersey

Consumer Complaint:

We (husband and I) had Oxford coverage from Jan 2000-9/30/08. Husband was full-time employee as of 6/2008. With job we were covered under United Health Care. They are refusing to pay for pre-existing conditions. I need to know the law re: pre-existing condition in the state of New Jersey. I know it is a different policy, however United and Oxford have or will soon be United. Oxford has always paid.


Insurance Expert Answer:

If you had continuous coverage under a group plan, there should be no issue with preexisting conditions under most large employer provided GROUP plans. However there are far too many variations based on employer size and type (eg. Private vs Govt vs religious org) and in some cases state laws that we can't give any definitive guidance.
