Consumer Complaint:

On 10-19-2007 I was involved in a car accident and was found guilty. My insurance company was contacted but did not let me know what was going to be done. I then received a summons to appear in court on 6-10-2008 because the other person's insurance couldn’t get a hold of my insurance and they were suing me for $2,819.57. I then tried to contact my insurance to let them know and they informed me that they were not responsible to pay for anything and they would get back to me to let me know if they were going to go to court and handle it. I never heard back from them. I tried to contact them but I was directed to voicemail after voicemail. I paid the money to keep from going to court and would like my money back from the insurance company and would like to know why they did not help me.


Insurance Expert Answer:

Under your policy you have a duty to promptly report all accidents to your insurance company and then they have to defend you if the policy was in force. They also have the duty to pay any judgment the other side recovers against you after a trial - up to the policy limit. My guess is that the insurance company will claim you did not notify them in time about the accident and/or they were prepared to defend you in court, but because YOU decided to settle the case on your own they are not liable. While I don't know what you mean when you say you were found guilty (unless you're saying you got a ticket and the court found you guilty of the violation that caused the accident) we suggest you write a letter -- calls to 800 number call centers too often are ignored, sometimes as they are answered in India -- to the CEO of the insurance company and keep a copy. Attach proof of payment. Complain to the Illinois insurance Department.
