Insurance Carrier: Geico
I hold auto insurance issued in the state of NY by Geico. My car was parked on the street on 12th of Sept. By the time I got back to pick up my car I saw that a hit and run driver had crashed into the back of my car creating a 3 car pileup. Police gave me a report with no information on the hit and run driver. The license plate of the hit and run driver was not taken down by any witness. I called my insurance company to recover damages under my Supplementary Uninsured Motorist clause and I was denied. I was told by the insurance agent that the hit and run driver has to be identified in order for me to be able to collect damages. My NY policy clearly indicates that hit and run motorists are considered as uninsured motorist but the insurance agents argued that in the state of IL the hit and run driver must be identified. I would like to receive help in order to collect damages for my car that is totaled.

I am afraid we can't help on this as it relates to some policy details on NY policies we are not familiar with. GENERALLY it is only COLLISION coverage that pays for damage to your car from a hit and run driver -- regardless of who is at fault, while uninsured and underinsured motorists' coverage pays for personal injury damages. Sorry.
